Election Petition: Mahama resort to two witnesses instead of five

The petitioner, John Dramani Mahama and his legal team have filed the document of two witnesses instead of five to testify on behalf of the 2020 presidential candidate of the National Democratic Congress (NDC) in the ongoing election petition hearing.

This follows court order to present the witnesses statement by the close of Wednesday, January 27 in order not to have their petition thrown out of the Supreme Court.

The two witnesses are the NDC’s General Secretary, Johnson Asiedu Nketiah, and Dr Michael Kpessa-Whyte who was Mr Mahama’s representative in the Electoral Commission’s national collation centre (strong room) on December 7, 2020 till the results were announced.

The 2020 presidential candidate of the NDC earlier indicated that he had five witnesses to testify against the Electoral Commission but now would be calling only two witnesses to testify for him.

Former President Mahama is seeking to set aside the results of the election that went in favour of the New Patriotic Party’s  (NPP) Nana Addo Dankwa Akufo-Addo.

The court on Tuesday, January 26 served notice it had the power to sanction Mr Mahama’s legal team including dismissing the election petition should its orders be disobeyed.

This was after Mr Mahama’s team had failed to obey an order on January 20 directing them to file witness statements and legal arguments relating to the initial objection by the respondents.

The two documents have since been filed by the petitioner’s team to enhance the hearing process.
