Supreme Court dismisses Mahama’s motion to inspect electoral documents

The Supreme Court has dismissed a motion filed by the petitioner in the Election Petition, John Dramani Mahama, for seeking to be granted permission to inspect documents of the Electoral Commission (EC).

His lawyers, led by Tsatsu Tsikata, filed the application on Tuesday, February 2, 2021 to help the petitioner  know the actual results that were collated by the EC.

The documents they wish to inspect include the original constituency presidential election result collation forms for all constituencies, constituency presidential election results summary sheet, regional presidential election summary sheets for all regions and the declaration of the presidential results form.

Mr Tsikata stated that, their request to inspect the documents follows the EC chairperson, Jean Mensa who was also the returning officer of the elections consistent change of figures of the presidential results.

He said the petitioner and his party members were confused about the actual figures which were collated and wanted to inspect to fish out the actual figures the EC used to arrive on her decision in declaring Nana Addo Dankwa Akufo-Addo as the President of the country.

But the justice ruling the case, Justice Anin Yeboah stated that the petitioner demonstrated that they already own copies of the original documents they were requesting to inspect.

He maintained that the petitioner and his witnesses also failed to argue on the authenticity of their documents, thus did not warrant them to inspect the documents the EC has.

The Justice said if the petitioner was able to demonstrate to court that the results they had was questionable it would have indeed be prudent to inspect EC’s own to clarify their doubts.

The court has adjourned the case to Friday, February 5, 2021 at exactly 10:00am.
