Asiedu Nketia subdued as Lawyer Ampaw exposed the ill-health of NDC’s petition with these top 4 questions

The General Secretary of the National Democratic Congress (NDC), Johnson Asiedu Nketia has been subdued after the lead lawyer of the Second respondent, Mr Ankoto Apaw jabs him with questions that exposed the ill-health of John Dramani Mahama’s petition.

The lawyer on Monday, cross examining Mr Nketia asked him tough questions that sent a mad rush on the body of the first witness to the petitioner.

Among the questions that rendered the petitioner’s petition irrelevant during the hearing was when Mr Ampaw demanded Mr Nketia to explain to the court how the pen drive which was part of his evidence had content which he had no idea of.

“General, I know that when you purchase a pen drive it is empty and the data on any pen drive is generated by someone. So the pen drive that you attached to the hard copy and exhibited as Exhibit ‘‘F’’ who generated or placed the data on it? Because when you were asked, you said you don’t know what was on it. Who generated the data on the pen drive?” he examined.

Mr Nketia who was escaping the question said “My Lord, as I said, honestly, I had not seen the pen drive and its content until today. The evidence is gathered by our election and legal directorate. They just gave to me to attach to my statement.”

Touching on Mr Nketia’s claim of figures if being correct after they adopted the science and math quiz approach to prove to court that the second respondent, Nana Addo Dankwa Akufo-Addo passed the 50 plus One threshold.

“In all figures that were shown to you as valid votes cast you were saying ‘if the figures were correct, if the figures were correct’, and that there were inconsistencies in the figures. I want to ask you…. what were the total valid votes cast in the Presidential elections held on the 7th December in your own calculations? Chief Justice Anin Yeboah was also quick to add his question ‘you claim you had polling agents in all the 275 constituencies,’ they asked.

Mr Nketia surprised the court and viewers with an answer that suggested that they came to court with proof but mere assumptions that non of the presidential candidate did not reach the 50 plus one threshold.

“My Lords, I have not brought that figures to court,” he revealed.

Mr Ampaw was quick to ask that “From your own calculation, how much of the valid votes were cast in favour of the Petitioner (John Mahama) to your knowledge?”

“My Lord, I don’t have them here,” Mr Nketia responded.

“What figures from your own calculations did the Second Respondent get as the total valid votes cast in his favour?” Mr Ampaw examined.

“My Lord, I don’t have the figures here,” Mr Nketia stressed.

The answers given by Mr Nketia to the four questions provided more clarity to the conclusion of Lawyer Akoto Ampaw’ statement that the NDC has no case

‘‘Mr Nketia, I put it to you that your petitioner’s petition shows no reasonable cause for action.”

“I am putting it to you further that the petitioner is not entitled to any of the reliefs that he seeks. You have no case worthy of hearing before this court,’’ he rested his case.

The most embarrassing moment of the day was when Mr Tsatsu Tsikata’s unsuccessful attempt to save General Mosquito from further embarrassment by interjecting that Mr Nketia did not exhibit the pen drive as evidence attached to his witness statement.

The court resumes today with Dr Kpesa Whyte, the second witness of the petitioner in the box being cross examined.
