The counsel of the first respondent, Justin Amenuvor has proposed to the Supreme Court to withdraw his witness, Jean Adukwei Mensa from cross examination over what he termed as lack of evidence to support relief by the Petitioner, John Dramani Mahama.

According to him, all the three cross examination conducted at the court over the past weeks have shown clearly that the Petitioner has no evidence to back his claims, hence his decision.

Mr Akoto Ampaw, the the lead counsel for the second respondent, President Nana Addo Dankwa Akufo-Addo also argued that he would not need any witness to testify again.

The two counsels argued that the evidence presented by the witnesses for the petitioner and from cross-examination does not support the reliefs being requested by Mr Mahama in the petition filed.

Citing Order 36 Rule 43 and C.I 87 rule 3 (e) 5, lead counsel for the EC, Justin Amenuvor told the 7-member panel of judges that the EC was satisfied with proceedings so far and asked the court to make a determination on the petition before it but Mr Tsatsu Tsikata, lawyer for the Petitioner disagreed.

He alleged that the move by the first and second Respondents was a deliberate attempt to avoid the Electoral Commission (EC) Chairperson, Jean Mensa to avoid cross examination which would expose the irregularities and illegalities that characterised the December 7, elections.

The court adjourned the case to Tomorrow, February 9,2021.
